1. Service Description

Tellexa provides AI-powered assistant services accessible via Telegram, WhatsApp, and web interfaces. Our services include personal assistance (Tellexa PA), DevOps automation (Tellexa DevOps), document processing (Tellexa Dox), and other AI solutions as described on our website.

2. Account Registration

To use our services, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activities under your account

4. Subscriptions and Billing

4.1 Subscription Plans

We offer monthly and annual subscription plans. Prices are quoted in South African Rand (ZAR) and are subject to change with 30 days notice. Annual plans offer a discount equivalent to one month free.

4.2 Payment

• Payments are processed securely via our payment providers
• We accept major credit cards, debit cards, and EFT for enterprise customers
• Subscriptions are billed in advance on a recurring basis
• All fees are exclusive of VAT unless otherwise stated

4.3 Failed Payments

If a payment fails, we will attempt to process it again and notify you. Access may be suspended after 7 days of failed payment. We reserve the right to terminate accounts with persistent payment failures.

5. Cancellation and Refunds

5.1 How to Cancel

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period.

5.2 Refund Policy

• Monthly subscriptions: No refunds for partial months
• Annual subscriptions: Pro-rata refund available within 14 days of purchase if you have not substantially used the service
• Free trial: No payment, no refund needed

5.3 Effect of Cancellation

Upon cancellation, you retain access until the end of your paid period. After that, your access will be suspended and your data will be retained for 90 days before deletion. You may export your data before this period expires.

6. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malware, spam, or other harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services or infrastructure
• Harass, abuse, or harm other users
• Generate content that is illegal, harmful, or promotes violence
• Impersonate others or misrepresent your affiliation
• Use automated systems to abuse our services beyond intended use
• Reverse engineer or attempt to extract our AI models or algorithms

7. Service Availability and Limitations

7.1 Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice when possible.

7.2 AI Limitations

Our AI assistants are designed to help but may occasionally produce inaccurate or incomplete responses. You should verify important information and decisions. AI responses do not constitute professional advice (legal, financial, medical, etc.).

7.3 Usage Limits

Subscription plans may include fair-use limits on requests, storage, or other metrics. We will notify you if you approach or exceed these limits and may offer upgraded plans.

8. Intellectual Property

Our Property: Tellexa, its logo, and all related technology, software, and documentation are owned by Tellexa and protected by intellectual property laws.

Your Content: You retain ownership of content you provide to our services. You grant us a limited license to process your content as necessary to provide our services.

9. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not responsible for third-party services or content

10. Indemnification

You agree to indemnify and hold harmless Tellexa, its officers, directors, and employees from any claims arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to our services if you violate these Terms or if required by law. Upon termination:

• Your right to use the services ceases immediately
• We may delete your data after 90 days
• Provisions that should survive termination will remain in effect

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of South Africa.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through our services. Continued use after changes constitutes acceptance of the new Terms.
